The purchase or sale of commercial real estate has many more far reaching implications and issues. Often inspections are more difficult, guaranteeing the bank loan by individual owners is often required, and environmental issues need to be addressed and resolved to avoid any long-term negative consequences.
Many times a phase one environmental study is necessary to protect the buyer. If environmental deficiencies exist on a property the owners and almost all prior owners or interest holders have some significant responsibility in the cost of the clean up. The purchasing party needs to know before the purchase what they are facing, in order to avoid problems where possible.
