Filing Fees and Approval
The Secretary of State’s filing fee for either a Limited Liability Company or a Corporation is presently $90.00. Whitmore Law Office often advances that filing fee so that the application for the new business gets processed as soon as possible. We then bill the client at a later date.
A partnership does not require an approval from the Secretary of State’s office, although if a partnership wants to register its name or use a name or names other than its own name in business, that does need to be recorded with the Recorder in the county that it operates and with the Secretary of State.
While awaiting the approval of the business form from the Secretary of State, discussions necessary for the Operating Agreement (in a Limited Liability Company) or the Organizational Minutes (of a Corporation) are completed.
