Gaining approval for placement could easily take two to three months. The goal is to be ready with all approvals, with Consent forms prepared and the Petition for Adoption ready for filing within two days after the birth.
Prior to these new requirements, an attorney needed at least a couple of months prior to the birth for the coordination and preparation of legal documents. The new requirements for approval from a licensed child placing agency and criminal history checks may require a family wanting to do a private adoption to have at least an abbreviated home study and other things done before learning of someone who wants to give up their child for adoption or at the latest, four months before a birth. This earlier action and preparation is to help insure that a child isn’t required to be placed in a foster home after birth and until the adoptive family has completed all the requirements. Delaying the placement in the perspective adoptive parents home is difficult emotionally and makes the process more expensive to the adoptive parents.
A couple wanting to adopt privately will need to be more prepared and much earlier, so that they are ready when the opportunity for a private adoption presents itself. Whitmore & Associates assists in the coordination of these requirements.
If the natural parents voluntarily terminate their rights, it is necessary that they knowingly do so. To be certain this is the case, they need to meet with and have their rights explained to them by their own attorney, who is knowledgeable in the adoption area. Consents from natural mother need to be signed after the birth.
