ADOPTIONS
There are generally three types of adoptions:
1. Step-parent adoptions 2. Agency adoptions 3. Private adoptions
Each type is unique and requires a different approach by the attorney and prospective adopting parents.
Step-parent Adoption
This adoption is very common. It is the adoption by a stepfather or stepmother of the other spouse’s child. Adoptions by Grandparents or Aunts and Uncles usually are in this step-parent category. It requires the termination of the rights of the non-custodial parent by agreement or court action due to some factor under the adoption statute. It always requires notice to that natural parent whose rights are to be terminated.
Actual written notice through the form required by statute is best. If that parent’s whereabouts is unknown and can not be found, notice by publication in a local newspaper or newspaper in the town that natural parent was last known to be, can be sufficient if the court approves that notice. Finding a parent is usually possible through a relative or the internet.
Stepparent adoption requires a home study by an agency appointed by the court (presently a $250.00 cost in most situations). The adoption takes about 3 to 3 ½ months from the first call to this office. The process usually ends with a 10 minute uncontested hearing, with an Adoption Decree signed and delivered to the parties that day.
